No need to apologise Peter as no offence is taken. The discussion is
merely becoming particularly useful.
The complexities of the governmental demands, reflected in legislation,
again merely reflect the complexities of the data protection role.
Mapping the fair obtaining and subsequent use of data properly, together
with assuring all the principles are complied with is required in what you
describe within the legislation quoted. Add to those pieces of legislation
quoted:-
The Housing Act 1996 (sections 144 and 156)
The Learning and Skills Act 2000 (various sections)
The Employment Act 2000 (sections 13 and 14)
The Freedom of Information Act 2000
The Public Interests Disclosures Act 1998
and virtually any other piece of legislation; as they increasingly
necessarily contain details of how and where personal data can be used.
(Due to HRA compliance statements?)
Add to those the internal context of organisational controls, values and
need to survive, and we begin, I think, to gain an insight into the
difficult area in which data protection practitioners
work/debate/deliver/survive.
Keeping up to date with the legislative changes affecting ones
organisational arena now appears to be a must for DP practitioners if errors
are not to be made. Additionally I found legislation could (although not
always) significantly simplify many aspects of DP work.

Then have a think about the voluntary bodies who often have the data - their
position under the sensitive data SI, their position vis a vis the people
they are trying to assist.
Oh then add in CCTV, the requirements of RIPA and the HRA....
Then add in the problems of the YOT's and every other under funded soul in
local government.
Now add in Sod's law ( Murphy for our US readers) and the usual risks to
data and you have ......
a recipe for disaster.
Apologies Ian - quite a bit for you to read there!
Peter :)
