We have made it part of our policy to delete any staff leaver's mailbox and personal drive, contents and all, entirely 4 weeks after they leave. We make this absolutely, abundantly clear to both the owner of the mailbox, and their Line Manager/Department Head, before the individual leaves, allowing them to forward any mails that might be required by colleagues, or to transfer them onto shared drives, or to ask for an extension of time etc. If the individual has already left, we would try to contact them to let them know that unless we hear from them to the contrary, any files remaining in their mailbox/personal drive will be made available to their former line manager. The only exception we make is where either the individual/manager has been involved in some sort of dispute ie. sacked/disciplined. Hope that helps.

Can someone clarify for me the legal restraints (if any) on data left on
our servers by ex staff?
Example: A manager needs access to a folder that only the individual had
rights to when an employee. As that employee reported to said manager
surely they then have the right to move, alter or delete anything that has
been left there?
Also, is there a distinction between college related data in that folder
and any personal data left by the employee?
Any help gratefully received.
