Local government put in bids for CCTV equipment and running costs. To forget
about the cost of fulfilling legal obligations such as subject access
requests would be remiss of any bidder. It would be unlikely that a failure
to adequately cost a CCTV installation would be enough to claim a
"disproportionate effort" defence.
Nothing, repeat nothing, can be removed or "fuzzed out" except images of
third parties from whom you do not have consent and where it is unreasonable
in the circumstances to disclose without their consent.
If you saw the Mark Thomas programme on TV you will realise that some
organisations have already supplied reasonable lengths of CCTV footage to the
data subject with effective blanking of third party images.
He was, however, easy to pick out. He was in amongst six morris dancers and
he carried a huge sign saying "My name is Mark Thomas, can I have a copy of
the tape please?"
However, although LB Newham have sophisticated "image match" software for
their CCTV system where the moving video image is measured against still
images provided by the Met Police, they couldn't pick out Mark Thomas or the
morris dancers from other people in the street so they failed to supply the
footage. I understand he has complained to the OIC.
