The discussion was in April/May 2000.
To find the thread I went to http://www.jiscmail.ac.uk , Selected 'D' from
'Browse Lists Alphabetically', Selected 'data-protection', Selected 'Search
the Archives' and entered in the top 'search for' box "Confidential
reference" leaving the other boxes empty.
This revealed a number of responses the most obvious to answer your question
being:-
