I suspect that the regs/guidelines were drawn up in a hurry
by Civil Servants who did not have time to consider the
implications of what they were writing. Perhaps if this
issues, and perhaps others that come to light, are pointed
out to the DfEE they could consider making some changes, at
least for the Sept 2001.
