On the basis of the wording in the Act, my assumption is that the functions of an HEI that count as those of a public authority are the same ones which are currently judicially reviewable. So a decision to discipline a student, or to decide that mitigating circumstances didn't apply or a range of other functions would be. A decision to discipline an employee would generally simply be covered by the usual employment law, and a contractual dispute with a supplier would be just that.
