This is a note for all local authorities that have responsibility for
schools. I've been working on guidance for schools on moving to the new
notification system, and checked with the Commissioner's Office before
sending out advice to Devon Schools.
Janet Davis in the Notification Section informed me that, contrary to the
ODPC advice at http://www.dpr.gov.uk/notify/2.html#2j, (that controllers
with more than one register entry must be amalgamated if they do not want to
move to the new notification system straight away), this does not apply to
schools. Schools cannot amalgamate their register entries into one, as they
are under the 1984 Act regime until they move to notification, and must
retain their 2 separate register entries for Headteacher and School
Governors, as they are separate legal entities.
It's good news for me as I no longer have to issue advice to schools how to
amalgamate their register entries, and only advise them on keeping them up
to date.
The Notification Section has started to receive one or two requests for
amalgamations for schools in the UK - one local authority has already had
to re-do the advice they gave to schools not to request amalgamations.
