Good morning all.
I have been made aware that our Business Rates department receive a number of requests from utility companies providing copies of Business Rates Statements (that their customers have provided for proof of date of first occupying premises) asking if they are legitimate or not.
I am guessing this is because there has been a gap between the previous occupiers and the new occupiers.
Whilst we have come across the odd one which has been amended, the majority are legitimate.
Can I ask if this happens at any other authorities and if so, how anyone responds?
To me, the issue is, first of all, where a business stated, are the statements personal information? I would argue yes in all cases
Second, if it turns out that they have been amended, would this be a disclosure under Section 29(3)
Third, if they are legitmate copies, would this disclosure be in the interests of the data subject
I really can't make up my mind on this one, and may be totally off the mark.
