I thought LinkedIn actually didn't share people's email addresses? But I understand that LI was only an example.
I agree PECR doesn't come into the picture, because of the "corporate subscriber" clauses.
So is there a Schedule 2 condition for processing my email address where it is of the [log in to unmask] type? I agree with Renzo that para 6 probably works, although given that when these firms selling my email address cause me to receive large amounts of spam, it could be said to be unwarranted by reason of prejudice to my legitimate interests (in not having my time wasted).
There's also the point that the data subject has the s11 right to require a controller to stop or not to begin processing. Whenever I get emails offering me lists of email addresses, I give them notice that I require them not to process my email address, including by selling it on to others. No idea if this has any effect, but it slightly relieves the feeling of irritated helplessness....
