We receive frequent requests for CCTV footage from the above solicitors asking for CCTV footage of their insured clients road traffic collision. We get at least 1/2 per week.
At the moment, we have never had any CCTV footage to disclose due to there being no footage or no cameras in the specified locations. However, can I ask, do you recieve these requests and if so, how do you deal with them?
Do you answer the request?
Do you disclose?
Do you treat as a Subject Access? (even though this may consistute enforced Subject Access)
Do you deal with as FOI Requests?
Do you have a process for charging and supplying the information?
I know that the Police Service have an agreement with the Assocaition of British Insurers for insurance companies to obtain crime reports (for free) if they believe a claim is fraudulent, however, we appear to receive these requests too often for this to be the case and they do not state that they require it under any section of the DPA.
