There is something in one of the Education Acts which states that the records of a school which closes is the responsibility of the LA in which it is situated. I believe this is the same for Academies even though the LA has no responsibility for them, but I'd have to check the Act(s) to be sure of this. Can't remember off the top of my head exactly which Act it's in (it's been a year since I worked in a Children's Services in an LA so my knowledge is starting to fade...) but I know there is something there. I believe the wording of the Act in question included Academies in their definition of a school/education establishment.

Here, when a school closes or they become an academy, the records, of ex-pupils at least, are returned to us and we become the DC for them.
The interesting question for me is what becomes of the records of an academy when it closes? The local authority aka LEA, no longer has any substantial connection to the school, (at least as far as I'm aware anyway) so who bears the responsibility of retaining those records. I'm happy to be corrected on my understanding though.
