Well, I am sorry if somebody may have read in my previous post a pessimistic message about the whole matter. While appropriate legislation may need decades to develop (this is the realistic conclusion of my recent article about legal implications of the BYOD trend, forthcoming in LIM 13 (2013) n.2), I believe social acceptable and sensible behaviours within online environments can be designed and promoted.
Of course there is great space for failures, but... since I am bankrupt at present let me consider the other side :)
For instance, if Google had asked me about the collection of WI-FI data of private individuals I am sure they could have saved some of the 7 million dollars they spent to settle the case with 38 USA States. Not just that: they could have invested some of this huge amount of money wasted in fines and legal expenses to create new services instead, managing personal data in respectful ways, they could have created new jobs, and good contracts, and positive feedbacks for the industry and the regulators as well...
