Hi Everyone

Sorry - this is a complicated issue so this email is rather long and 
detailed!

We have got 2 prospective students who are planning to bring live-in 
carers with them.  They will be living in Halls of Residence.  They have 
pretty much sorted out their care packages and will receive direct 
payments, but we are still struggling to sort out how the cost of the 
carers' rooms will be met.

I understand that, historically, this cost has been met by the student's 
social services as part of their care package, but the Social Worker of 
one of these students says that this changed in April 2011 and that the 
student now needs to apply for Housing Benefit.

The Skill booklet 'Personal Care at University' states: Housing 
allowances and additional rooms for carers. From April 2011, disabled 
people claiming housing benefit will be entitled to funding for an extra 
bedroom for a carer. Contact your local authority for details.

I am not clear that this means that there is now no onus on the 
student's social services to meet the cost, or just that there are now 
two different ways this cost can be met - does anyone have any ideas?

There are all sorts of other issues here, including:

- the amount of housing benefit will be capped at the Local Housing 
Allowance, and there will inevitably be a shortfall: who is responsible 
for this?

- in order for the student to claim HB for the carer's room, I believe 
that the contract / tenancy agreement for BOTH rooms needs to be in the 
name of the student. (We don't have any dedicated flats with carer 
facilities so it will be 2 adjacent rooms within a standard hall).  Our 
Halls Office can do this, but there are implications for things like 
residents lists for receiving mail, fire evacuation, etc. which will 
need to be addressed as the Carer will not be on the system if no 
contract is issued in their name.

I have not yet contacted our local Housing Benefit Office, but can bet 
they have not encountered this situation before and I am hoping to be 
armed with some guidance or regulations when I contact them. (I think 
the student has to apply to the local HB office as they will temporarily 
resident here ??).

I would really appreciate any information or suggestions of where I can 
find further details, or even just to hear that someone else is looking 
into the same situation.
