As people dealing with regulatory issues (like Health and Safety), it is quite easy to feel under appreciated. One way to help resolve that is to explain your role and how it helps the others in their role. By that I mean, explain that your help will keep them out of jail, in a job, and out of the papers.
If they prefer to be out of a job, in the press, and in jail, then they can continue to ignore your advice. By stressing that you are working for and with them, it helps to reduce the concerns about being appreciated for their skill sets.
To put it differently, but directly, you could ask them about the 3 most recent decision notices on the issue. If they can discuss them cogently and clearly, it is unlikely they are going to need much help. By contrast, if they stare blankly at the mention of a decision notice, then they should start to realize that they need a bigger boat because the ocean is large, deep, and full of sharks. :)
If you want to be very Machiavellian, you could explain that if the ICO comes to investigate and you were not consulted on the response, then you would be honour bound to explain in excruciating detail everything that went wrong and why. By contrast, if you were included in the response then you would be in a better position to avoid the ICO arriving and would take an interest in making sure that if the ICO arrived that everyone would be in the best possible light. :)
