I don't think they are Data Processors, I think they are agents of the Data
Controller, like paid staff and volunteers. They still need guidance on the
proper handling of personal data (and other confidential information), of
course, as part of their induction as governors.

Which does of course raise a different question as to whether they are
data processors - in which case do you have compliant data processing
agreements in writing ? I cannot offhand think of an exemption which
would disapply principle 7. Or are they covered by the authorities
registration ?

I would tend to agree. Under the 1984 Act a school itself and its
governing body were separate Data Controllers. Under the 1998 Act, the
Notification guidance explicitly specified that they were to be regarded
as a single Data Controller. I assume the same applies to any other
educational establishment.

In my view the simple answer is yes.
It may help to think of it first in terms of FOI. Clearly this is
information 'held' as it is held by the Governor on behalf of the
University.
To avoid disclosure to a third party you would want to use s40(2) (first
condition) - logically therefore in this case since it is not a third
party, s40(1) applies and you deal with it under s7 DPA.

individual has asked for information relating to them held by members of
our Board of Governors. Our Governors are independent and any
information they may hold (in emails or on paperwork - such as notes
written at a meeting) would be held on their home email account.
Would they required to disclose this information in response to the
Subject Access Request received by the University?
