I hope that someone more knowledgeable than me will be able to give me some advice!
The University contracts with agents for the recruitment of some overseas students. The contract includes a requirement to abide by the University's DP policy and all procedures for the handling of personal data which include that personal data must not be transferred to other parties without consent.
One of our former agents is currently disputing commission owed for a number of students, details of whom we have confirmed to the agent in writing. The agent is now communicating with us solely through a solicitor and has now given the solicitor a copy of the list of names.
Is there any concept of the solicitor "embodying" their client (I'm sure there's a word for this but it escapes me) such that a breach has not taken place by the client transferring the list to the solicitor? Or is the agent in breach by transferring the list?
Both agent and solicitor are UK based.
