Even if a planning application relating to the provision of disabled
access to a home became "sensitive personal data", para 7(1)(b) of
Schedule 3 (processing necessary for the exercise of functions under
an enactment) and s 35 (disclosure required under any enactment) would
presumably allow publication. Otherwise, developments that might
directly affect neighbours, passers-by and local amenities could go
through the planning process in complete secrecy, with no opportunity
for anyone to comment.
