I cannot see that the Explanatory Memorandum  suggests otherwise*

Indeed it is quite specific "Tier 2 specifically excludes any data controller that is a charity or a small occupational pension scheme" 

If the intention was otherwise then they will need to redraft the SI because it is clear and unambiguous (though logically tricky as anything which defines and exclusion using a negative is)

* Although I accept it is badly drafted as the second and third sentences of 7.11 do technically contain a contradiction

The Explanatory Memorandum which accompanies the Statutory Instrument suggests otherwise i.e (a) and (b) OR (c). The distinction is made because it is recognised that a public authority with more than 250 employees may not have a 'turnover' greater than £25.9 million. It states that:

7.11. The fee payable by tier 2 data controllers will be £500 per year. 
Tier 2 will encompass all data controllers with 250 or more members of staff and a turnover of £25.9 million or more, as well as all public authorities with 250 or more members of staff. Tier 2 specifically excludes any data controller that is a charity or a small occupational pension scheme

7.12. The tier criteria are based on the existing criteria used by the Department for Business, Innovation and Skills (BIS) (previously the Department for Business Enterprise and Regulatory Reform) for determining the size of an organisation, which includes turnover, number of employees and balance sheet total. These have been adapted and simplified to reflect the need for administrative simplicity for both data controllers and the IC. Turnover and members of staff are appropriate criteria for most data controllers; however public authorities will not necessarily have a turnover. In this instance, the number of members of staff is used as the only indicator of a public authority?s size. The definition of public authority appears in section 1(1) of the DPA.

No need for debate. Conditions (a) (b) and (c) must all be satisfied before it becomes Tier 2.
 
If you are a registered charity you do not satisfy condition (a) - therefore Tier 1

This is wide open for debate I think and I can see the help-lines going into meltdown with us all asking these questions. We are a Registered Social Landlord, a registered charity with over 250 staff and a turnover in excess of £25.9m and perform the role of a Public Authority. This could get interesting :O)

Also what happens to the Notifications for the Electoral Registration Officer, the Youth Offending Team and the Registrar of births, deaths etc ?
Do they count as a local authority or pay the lower rate as having under 250 employees ? It doesn't mention those.
