Dear Adam
The DPA covers the processing of personal data within the UK regardless of
the nationality of the individual concerned. It would not make sense for it
to do anything else.
Section 5 applies to Data Controllers not to Data Subjects. For example an
individual such as myself, processing personal data in connection with my
work or hobbies, and acting as a Data controller, is covered by this section
of the Act.

Hello
What is the situation re the DPA and screening of incoming passengers from
non-EEA countries? Does their personal data have to be processed in
accordance with the DPA? Sorry if I'm missing something obvious, but I
note that the DPA applies to individuals 'ordinarily resident in the
United Kingdom' (s5 (3)(a)).
I'm particularly thinking of fingerprinting, thermal imaging, blood tests -
all of which have been suggested (and in some situations happened) at UK
airports.
