The school sets the system (even if most follow the LA's guidance).
They could make the qualifying date for residence later than January (in
my area it's as early as the previous September) if they are worried
about people moving before the kid gets to the school. Even then, I
doubt they'd propose chucking the kid out if the family moved house on
the second day of term.

Keeping the children together at the same school is, in my opinion, more
important that 2 miles, IMHO. But I know many schools disagree.
