Boot on the other foot time.
I have been asked to investigate how we can obtain information from the DWP
given the following scenario.
Persons acting on behalf (either formally or informally) of a service user
collect benefits from DWP on behalf of the user which should, in part, be
paid to our authority, because the benefit is means tested and part of it
relates to residential care costs for the client. We pay the care home in
advance and recoup the dwp payment element from the users representative.
Sadly some representatives instead spend the money on other things, leaving
the Council out of pocket. We then need to go to court to get the money
back. DWP used to provide to us the names of the representative. Now,
they refuse and would you adam and eve it, ask for our statutory powers!
Strictly this is not an issue for me but I have been asked to assist.
any ideas?
