If I remember rightly, very soon after the Act came in it was established
that even if a name is data about a person's ethnic origin or religion, and
therefore sensitive, it has been made 'deliberately public' by its holder,
and therefore automatically meets a Schedule 3 Condition. Any decision on
publishing a name that identifies ethnicity, race or religion is therefore
only dependent on meeting a Schedule 2 Condition (and all the other
Principles, of course) in the same way as a name that does not carry any
significant additional information.

Subject: Is your name racial or ethnic data ?
We are intending to publish our Building Regulations and Planning
Applications on our web site. By publishing the applicant's name are we
disclosing or suggesting their ethnic origin ? For example, does Ahmed ibn
Mohammed disclose sensitive personal data any more than Joe Bloggs, or
Francois Granjard ?
I hasten to add that these are names I have made up.
We do not intend to identify disabled adaptions.
What have other Authorities done ?
Thanks
Brenda
