Definitely not. Not only that, it may also be an unlawful disclosure,
depending upon where the authority came from for giving the list to the computer
company.
The problem lies in the disclosure to the other company, not in the marketing
itself. As such, the computer company has probably committed no offence but
the organisation which disclosed the staff list to them certainly has, unless
they had proper authority, and also unfair unless they obtained prior consent
from each and every staff member.
Incidentally, this company has tried this at lots of other organisations. In
most cases they have got a flat refusal, especially where the HR department
have bothered to ask their Data Protection Officer for advice. This company is
well aware of the DPA problems yet it continues to market in this dodgy way.
Other public sector bodies beware!
