It will be illegal, but not until the full provisions of part V of the Police
Act 1997 come into force, including the basic disclosures. I believe the
date for this to happen has been put back again - not sure of the new target date
or even if there is one.
The ICO tries to discourage their use but has no power to stop it happening.
