Consent is not the only Schedule 4 exemption - so I doubt your bank has, or
has needed to, assumed anything about your silence! Try looking at
exemptions 8 and 9.

I noticed most of the major consumer banks going through a similar exercise
recently (albeit on paper) where new Ts&Cs were sent, in which 'processing
outside the EEA' was introduced (one assumes Mumbai call centre!). I did not
respond to my bank, there was no request to do so, so my bank has assumed
consent on the basis of non response!
Are these two examples so dissimilar?
