"Why is it necessary" - That sounds like a value judgement requirement which
is likely to reflect the values of the social group the opinion is made from
within?
The DPA and some other pieces of legislation necessarily accommodate a
variety of values, if they did not things could become very structured, and
strictly hierarchical.
Clearly all decisions need to be made within the framework of the DPA, but
that does seem to allow for diverse perspectives, and facilitates many
values which those various perspectives incorporate. From that viewpoint it
would therefore seem important to retain as loose a framework of
interpretation and implementation as possible, otherwise many social groups
and their members could end up being excluded.
This group seems to benefit immensely from the open and diverse viewpoints
aired about the subject matter - each of which will be valid in its own
context; The ongoing open and free debates seem to be the important issue in
gaining a broader understanding amongst DP professionals. Being silent does
not progress matters for any social group, unless of course there is a
commercial reason for that silence.
A situation could arise where there would be no flexibility left for
organisations to use in facilitating change, or individuals for privacy
purposes if tightly focused interpretations are constantly put in place.
Gosh, could this be Durant all over again!
