Just to muddy the waters a bit, isn't this a case of vicarious
liability? The one who's in hot water is not the individual who does
the deed, but rather the employer who causes him (or her) to do it.
So the individual DPO should be covered by the organisation's
insurance policies, particularly Employer's/Public Liability and
Professional Indemnity.
Knowing in advance that you'd contravened the DPA would be an
aggravating factor, so it's clearly far better not to get into this
situation in the first place.
But it's Friday afternoon, and I don't think I know beans about this!
