My understanding is "old" customers should be given an option to opt out as
part of your mailings (you don't though have to invite them to explicitly
opt in our out).
New customers - I believe - have to explicitly opt in, not "tick a box not to
send you information".
You would have to check the preference service at least for your "old"
customers who have not opted in.

PS. So far I have only seen one company having an "opt in" box in their
marketing stuff.
