"The Data Protection Act 1998 [DPA] came into force on 1st March 2000.
Within the Act, there was provision for some exemptions from the DPA for the
on-going processing of manual records containing personal data, already
being processed immediately before 24th October 1998, in any relevant filing
system. These manual records were exempt from the principal operational
provisions of the DPA, such as the right for an individual to see what
personal data about themselves is being processed by the University, until
24th October 2001.
Implications: The immediate implications, from 24th October 2001, are:
If an individual, be it a current/former student or staff member, makes an
official Subject Access Request then any paper record, such as a reference,
must be made available to him/her subject to some conditions.
An individual may challenge the fairness, lawfulness, accuracy,
uptodateness, relevance, excessiveness, and security in the processing of
personal data, held in manual records, by the University.
Definitions: The following definitions may be useful:
Manual records are essentially paper records, card indices etc held in a
structured filing system.
Personal Data means information relating to a living individual who can be
identified from the information. The information can cover opinions on the
individual.
Processing of personal data covers obtaining, recording, storage, archive,
updating, editing, review, retrieval, manipulation, disclosure,
transmission, deletion, and destruction.
Relevant filing system means any set of information about the individual
that is structured to allow ready access. "
