In typical Greek manner a kind of answer to your question. Sometime ago
I thought to subscribe to one of the supermarket loyalty cards (the one
that is trying very hard to become a bank amongst other things). They
had a very similar sentence ... important offers from other
organisations would not be passed to me etc ... End result, I
subscribed, ticked the box not to receive info. and threw the card away.
I will not any more shop there unless I have to.
If I was receiving the above I would be very unhappy. The document may
be within the law but the "blackmail is blackmail whichever way I look
at it.
It is all rather confusing ... if you are chaning personnel payroll
systems (to one integrated system) I do not see why you have to ask
employees to agree. OK, asking them about passing their details to
other companies or to an external mail house and so on.
There will be a large number of non-returns which - my understanding of
the law - you have to take as negative answers (ie. not explicit
consent). If I were you I would try to separate the issue of a new
personnel/payroll system with that of any advertising material. Thus I
come back to "why do you have to ask employees about storing their
details". It is permitted to store personnel/payroll type information,
union membership etc.
