Yes, CVCP asked, as part of the consultation on the Bill, that
Universities should not be covered by the Act in the blanket sense of
being viewed under the catch-all phrase 'public authority'. The upshot is
that Universities are (very!) specifically designated in the Act. I may be
wrong, but my reading is that part of the sub-text of the original CVCP
objection was that the Secretary of State should separately designate
HEIs >in respect of certain of their functions< (basically those which the
public purse pays for) - ie. not in a way that would cover ALL activities
within a University. The outcome is, as far as I can see, that we have got
the window-dressing of separate designation, but not in a way that
allows any of our activities to escape the purview of the Act.
