My initials thoughts on last week's conference:
Report on the Data Protection Conference for HE: an update (6th May 1999)
- The new Act is not likely to come into force now until September;
- Two speakers from Southampton University were quite candid about some of
their difficulties, one with computer security and the other with a subject
access request. We should expect to be in similar difficulties, there being
no room for complacency;
- The Registrar / Commissioner is going to continue to take an educative
rather than an enforcing role with this new legislation. Blatant
infringement of the new Act will not be ignored, however;
- The Telecommunications Directive (97/66/EC) will probably apply to us if
we offer services over the internet. If we are involved with the provision
of networked services to the public, it will apply to that as well;
- Electronic mail will probably cause us the most difficulties followed by
the Web. This assumes we successfully manage the transition from the 1984
Act for our existing systems;
- Phil Boyd from the Data Protection Registrar's Office is looking for help
in understanding some manual filing systems. We could take advantage of
this with reference to our manual student record systems;
- The Guide for Good Practice produced by the Association of Colleges was
seen by Phil Boyd as a useful starting point, but we were encouraged to
press CVCP for a more definitive document;
- The Registrar's Office does not get many complaints about HE (to which
should be added "yet"). There are some practices, such as our wide
publication of results, which may be of dubious legality but for which
there do not appear to be complaints.
