I went to one of the seminars organised by the Registrar/Commissioner held
in Bristol on 18th August.
It was clear on asking questions that they do not have ( in general)
detailed advice available yet on the new Act.
However, as a 'rule of thumb', automatic processing eligible for the
exemption in phase one of the transition will be that on your current
register entry and that, in practice, the terms of the 84 Act will apply to
that for the period 24/10/98 to 23/10/2001. In other words, we have 3 years
to get up to speed with the new Act.
For manual ( "relevant filing systems"), there is clearly a gap ( gulf?)
between the government's intention as to what is covered and the
Commissioners view. I was surprised to learn that Notification is not
required for any "relevant filing system" even after 2007.
The policy I am going to adopt is to compile a record of the University's
major manual filing systems ( e.g. Personnel records and manual student
records etc.) currently in use.
Finally, it cannot be stressed too highly,
ANY NEW SYSTEM FROM 24/10/98 WILL BE SUBJECT TO THE TERMS OF THE NEW ACT.
