The whole business of the ruling from CLA and the inter-relation (or not)
with the DDA is obviously exercising plenty of grey cells round the UK!
Here in Edinburgh we have recently been the subject of a six week CLA
inspection so the business of copyright is fresh in our minds. Because we
spend much of our time working towards accessible learning environments, we
regularly 'manipulate text' by scanning it, enlarging it, simplifying it,
etc. for visually impaired students and others with specific learning
difficulties. We therefore approached the CLA directly to explain our case
and seek their approval for this type of activity.
It may be helpful to know that we received limited authorisation for this
activity - on the grounds that we must be able to demonstrate that:
a) The student (or member of staff) for whom the text has been modified, is
disabled
b) Access to that particular text is essential to the student's course work
or member of staff's work
c) We only undertake this activity as the need arises - not storing
'modified texts' from one year to the next!
We had to state our case in writing - and I think (but I am not sure yet)
that there may be a small additional fee to add this option to our annual
CLA licence.
