You’re not a judge or jury - so you can’t assess the plausibility of the “witnesses”. I would be minded to take the latter of your two options.
You don’t say whether, if it was a personal data breach, it was unlikely to result in a risk to rights and freedoms etc, but given the foregoing, I wonder if “unlikely” is the more, er, likely.
