We have a case at present where the father is seeking data relating to their child. The child has been charged with various offences but has agreed to a diversionary disposal which the mother has agreed to. The father is nominally listed as the parent/guardian, but appears to have had no involvement in the case. There is no evidence that the father is estranged from the family but there is a history of domestic violence by the father towards the mother and between both parents and the child - which are the subject of a separate investigation.
My gut feeling is that we should refuse the request on the basis that although nominally the father is the guardian, they do not appear to have any knowledge of how this particular case was dealt with - coupled with known domestic violence issues. On the other hand they are all as far as I am aware in the same house and not disclosing the data may put both other parties at risk.
Obviously it is difficult to assess the competence of the child in this instance.

I've known two instances in the last few years (as a volunteer Domestic Violence worker) where an estranged parent (father, it's always the
father) has vigorously exercised his 'rights' to obtain data from the school about his child (both aged well under 16) as a way to proxy-harass the mother.
While in theory the mother can go back to the court, this is both costly and time consuming. It would help if more schools took the view that "not getting involved" (which is an understandable initial reaction) was more aligned with "No, sir", than "Yes, sir".
ps By estranged I mean divorced and the subject of non-contact orders from Family Court.
