Possibly, but I was following on from Phil's post (sorry), mentioning the NHS example and looking at the provision 'or the management of health or social care systems and services' with a view to taking consent out of the equation when an independent investigator is looking into t complaint about medical staff.
With regard to the OP, I suppose the ability to allow an independent assessor to see materials - or not - will depend on what the materials actually are, rather than what they're labelled as. That is, in my experience, 'confidential' is a label that is often tagged onto things it doesn't apply to - which can tend to attract argy-bargy, either internally (from people who just don't want to disclose or release something) or externally (from customers who've had their expectations wrongly raised by well-intentioned but ill-chosen words).
