Hi all, I have been 'listening' intently with the advice and conversations on here. I have a question:
Can you advise that we are not in breach if we share confidential minutes with an investigator for the purposes of investigating a disciplinary matter?
I have read the ACAS rules on this and very little has been said by ACAS in relation to this post 25th May. My view is that we can share confidential minutes with an appointed disciplinary investigator for the purposes of fulfilling contractual obligations. The example I gave is that if I, as the DPO asked to see the material before it was being shared then staff would not be in breach by allowing me to review the information.
Any thoughts, counter arguments, laughter at my question?
