Despite my previous post if pushed I agree with Tim.
But sometimes we need to apply a little oil in aid of common sense.
Even ICO is not above this. There are examples in the (current) SAR Code of Practice where ICO effectively says "This is technically a breach but you can apply common sense and imply consent ... "
