It hadn't occurred to me you might be reading too far forward. Para 2(2) and (3) can be hard to understand for those who have not come across them. It applies to people like the IPCC who need to use the crime exemption even though their processing is clearly not for that purpose - otherwise a sneaky subject could bypass the exemption by making a complaint and then get the info from the IPCC once the police passed it to them ...
