We are also having some problems around a similar issue. We have an overseas exam centre in Dubai run by the Dubai Health Authority which run exams on our behalf. They are refusing to sign up to a data sharing agreement or to sign up to any data protection clauses to enable us to share personal data about the candidates with them so that they can carry out the exam. There argument is that DHA is a government organisation and cannot be penalized or taken to court in a foreign country and that UK Data Protection legislation does not apply to them. We have tried again and again to explain to them that it doesn't matter where they are we are the data controllers and as we are based in the UK we have to comply with UK data protection legislation which means we need to have this written agreement with them before we can share the information. We have come to a bit of a standstill on this. Has anyone else had a similar issue? I would be interested to hear how you have dealt with it or how you were able to resolve it. The only way around this is to find a much more complicated route whereby we don't supply them with any personal data.
