Whether and the extent to which ECJ decisions are binding was not my point. My point was that Article 6(1) does not affect the position, since to the extent that they apply now, they will be within the definition of retained law. 6(1) only applies to decisions etc. made after "exit day"
When read in full context "on or after" clearly links to "made" and "laid down" rather than "not bound". It cannot be read as "A court or tribunal— (a)is not bound ... on or after exit day ... by any principles laid down, or any decisions made, ... by the European Court" as the retained law parts would then be totally superfluous.
