Ruling looks completely right substantively but reasoning much more
problematic.
Incidentally, the RtbF in the GDPR will apply much more widely than when
consent is the legal basis. In fact by default it will apply to any
situation where "personal data have been unlawfully processed" (GDPR,
art. 18 (1) (d))!
