We take the approach that the statements are the personal data of the giver (it's their opinion of events) and so deal with the request in terms of section 7(4) of the DPA. We also take account of the purposes of a SAR (as stated in the courts - like it or not it is the law) which is to check the accuracy and use of personal data. It is not for recovery of court documents or for the purpose of litigation or defending a claim. Consequently, when assessing the competing interests we disregard any other interest of the data subject to access the statements which are not related to accuracy and use.
