I do not think this makes them employers - they simply buy services from a provider and the staff are still employed by the company / LA / NHS. The staff patient relationship is unchanged.
Staff professional duties to treat should override any qualms they have.
One trust I work with deals with it thus : see page 2 http://www.northdevonhealth.nhs.uk/patientinformation/general_info/code_of_conduct.pdf . It's about as much as you can do. Cameras in a care home are another issue.
