We've just been made aware of the new ICO guidance regarding costs that can be taken into consideration when estimating costs and, frankly, it's caught us somewhat by surprise.
The guidance now states that the cost of redaction, including officer time, can be taken into consideration when estimating whether a request exceeds the appropriate limit.
This seems to be a fundamental change to FOIA with potentially many more requests being knocked back on cost grounds.
One slightly confusing point that the guidance throws up is that you can't include staff time redacting when initially estimating whether a request will exceed the limit. This would seem to leave you in the position of having to carry out 2.5 days work (even if you know it's going to take longer) and then stopping to raise a s.12 exemption.
What are your thoughts on this guidance?
Also, does anyone know where this decision (to include redaction) has originated from, as we appear to have missed any indication that it was on the cards?
