Dear All,
Is anyone working on this project? I saw this link on Gov.uk and I thought at first it only applied to NHS. I recall the headlines at the time that GPs will be expected to report child abuse concerns.
However, what caught my eye, after reading it closely, was the following paragraphs.
"The project builds on existing infrastructure already in place in the NHS and represents an upgrade to existing systems rather than a wholesale system change. Information will be stored and transferred securely. Access to CP-IS information will be controlled by NHS smartcard security, which is already widely used for the secure handling of patients’ demographic and clinical data." [I did not realize we had an infrastructure in place for sharing child protection plans from local authorities to NHS]
"In practice, local authorities will feed information on children who are subject to a child protection plan or are looked after from their social care systems into a secure central data store area in the NHS national Spine. Then health professionals, during the process of registering a child at their care setting, will be informed of the child’s child protection status. As soon as basic demographic information is inputted, if the child is looked after or subject to a child protection plan, an indicator flag will appear on screen, with the contact details for the relevant local authority."
Does anyone know the legal basis by which local authorities will volunteer this information to the NHS? What is the legal basis for this sharing? I was looking at conditions 5 or 6, but I am not certain what public function this covers and how we resolve the condition 6 issues.
I would also be curious to know what Conditions from Schedule 3 are met by this sharing. Lacking explicit consent, I am uncertain.
Any thoughts or views? Are people already uploading on their systems? Has any legislation been passed that requires the sharing i.e. makes it necessary rather than a gateway issue?
Best,
Lawrence

Subject: [data-protection] SAR and Email Retention
Dear All,
I am hoping you can assist. A subject has requested copies of all emails held between a fixed period. We have responded with everything we hold however the requestor believes there is information missing. Can anyone please advise on what the guidelines are in relation to retention of emails concerning students?
Thanks
Bev
