We received a SAR from a staff member who had already resigned at that
point and initiated a grievance procedure, and who was working out their
notice. However, they had indicated a willingness to withdraw their
resignation subject to certain criteria, so we had intended to use the
'negotiations' exemption for some of the data.
The deadline for the SAR is next Tuesday.
This afternoon our HR department informed me that a letter of dismissal
was sent out to the data subject this morning.
Does the 'negotiations' exemption cease to apply the second the letter
of dismissal was sent?
I haven't been able to contact the data subject today to discuss a
possible extension on the SAR (in order to review the previously
exempted data), partly as they won't have received the dismissal letter
yet and I am also not sure they are entirely expecting it (I certainly
wasn't!).
I intend to speak to the data subject as soon as I can. But could the
above be considered reasonable grounds for our failing to meet the
original deadline for the SAR?
The answers are probably very obvious, but I've not had any experience
with a SAR of this nature before, so any feedback / advice gratefully
received, thanks.
