I think this comes back to risk assessment and a bit of common sense ;)
Many schools already provide parents with a consent form at the beginning of the year re publication of a child’s work, image and so on. If not, there may be issues such as identification, particularly with vulnerable children. At the end of the day, this is about celebrating the enthusiasm and talent of children, and as long as reasonable steps are being taken to prevent harm, there should be a workable solution here.
Possible steps:
- Getting permission is a 'no risk' option and where it can be done, it probably should be.
- Lowering risk; use of first names and school only (not class, perhaps age group rather than specific age?)
- Contacting the school to check whether there are particular issues (without them being disclosed) with publication would be a good idea in any case
- providing a statement detailing the planed activity and publication via school newsletters may also prevent issues arising later on i.e. if you would prefer your child's work not to be published, please _________________
Strictly, we could be talking about infringement of copyright in placing the work online but what harm is likely here where the work is published and it is attributed? Allowing an opt-out (prior to any writing) would certainly address these issues i.e. arguably provide a licence.
