If you follow the recommended practice of a tiered approach to fair processing notices and ultimately refer users to the Audit Commission Fair processing notice - Full text , this should not be necessary as this in turn refers to the guidance on types of data collected. If this changes, I suggest it is really up to AC to make the necessary changes, and that your duty of due diligence does not stretch that far given that you are effectively supplying under the s35 exemption.
